Tarion – Protection for New Condo Building Owners

The Ontario New Home Warranties Plan Act is administered by the Tarion Warranty Corporation. One of their responsibilities is to protect new home owners.

Tarion provides varying levels of protection to condo buildings and suites covered by the legislation.

When deficiencies arise in a new building, Tarion may offer protection to condo owners and condo corporations.

When a Tarion Warranty is involved, a new condo owner must complete a “warranty claim” which is delivered to the builder. The builder is provided with an opportunity to correct any identified deficiencies. If a dispute is not resolved, Tarion has authority to commence a “conciliation process”. Claims under a Tarion Warranty must be submitted within a prescribed period of time.

Should deficiencies exist in the common elements of a condo building, or if many condo owners are experiencing similar deficiencies, these are documented in a first year performance audit.
