Charter of Rights and Condos

Condo corporations are sometimes called the fourth level of government. For this reason some may feel that condo governance is subject to the same rules, regulations and requirements as other forms of government.

Condo corporations are a private agreement for the use of property for a common purpose.

The Charter of Rights applies to the Parliament and Government of Canada. It also applies to legislatures and governments of each province. It was not intended to protect private economic interests.

The Charter of Rights does not apply to condos and condo corporations.

These are the findings of the B.C. Supreme Court.
