Older condominium buildings, built prior to current accessibility requirements, may be required to undertake renovations to accommodate resident needs.
Where stairs or steps are the only access point to a building or common area, for example, a ramp may be required to accommodate a wheelchair. Renovations required to comply with the Ontario Human Rights Code do not require notification of or discussion with owners.
Accessibility upgrades are building enhancements that should be funded through the operating fund. The reserve fund, intended for major repair and replacement of common elements, is not intended for this purpose.
Where a condo corporation lacks funds to pay for an accessibility upgrade to comply with the Ontario Human Rights Code it may be necessary to raise condo fees, implement a special assessment or borrow funds.
