Most condo corporations do not allow common areas to be used for business. While this may be appropriate to protect common areas from misuse, there are times when this approach can derail desired programming for residents.
Problems relating to improper use of common areas may occur when an amenity such as a gym, exercise room or swimming pool is used by non-residents who pay a fee to a building resident for training services or lessons.
Building amenities exist to accommodate condo residents who pay monthly condo fees for use and upkeep. Fees are not paid to benefit non-residents who are paying customers of a building resident.
Any owner is entitled to bring in a personal trainer, yoga instructor or swim instructor for their personal use or even for shared use among other residents. This would likely be considered reasonable use of amenities.
No condo owner or resident should be running a business using common areas and receiving financial compensation. When a trainer or instructor does utilize common areas, they may be required to provide documentation to management attesting to their qualifications or liability insurance coverage.
